Die europarechtlichen Vorgaben für den Freiverkehr mit Abfällen und den zulässigen Umfang einer mitgliedstaatlichen Entsorgungsautarkie stellen den maßgeblichen Rechtsrahmen auch für die innerstaatliche Konzeption der Entsorgungszuständigkeiten dar. Neben den Regelungen der EG-Abfallverbringungsverordnung und der EG-Abfallrahmenrichtlinie kommen in diesem Zusammenhang der Gewährleistung des freien Warenverkehrs und den Wettbewerbsvorschriften des EG-Vertrages entscheidende Bedeutung zu. Die vorliegende Untersuchung beleuchtet die danach den Mitgliedstaaten für die innerstaatliche Steuerung der Abfallströme - z. B. durch Andienungs- und Überlassungspflichten - verbleibenden Spielräume, auch unter Berücksichtigung der Ausnahmevorschrift des Artikel 86 Abs. 2 EG-Vertrag. Damit soll zugleich ein Diskussionsbeitrag für die anstehende Novellierung des deutschen Abfallrechts geleistet werden.
