Die Art und Weise wie Vermögensteile als Sicherheit verwendet werden können, hat sich innerhalb der Rechtsordnungen Europas unterschiedlich entwickelt. Eine Reihe von Mitgliedstaaten sehen im Gegensatz zu Deutschland die hypothekarische Belastung von Mobilien und Unternehmen vor. Vor diesem Hintergrund untersucht die Arbeit die Bedeutung der Grundfreiheiten des EG-Vertrages für das nationale Sachrecht. Aufgrund des EG-Vertrages müssen sich insbesondere die lex-rei-sitae-Regelungen sowie die traditionellen sachenrechtlichen Prinzipien wie Typenzwang, Publizitäts- und Spezialitätsprinzip rechtfertigen und beweisen. Unter Einbeziehung verschiedenster Sicherungsrechte Europas, wie Frankreichs, Spaniens, Italiens, Griechenlands, Finnlands, Dänemarks und der Niederlande, resümiert die Arbeit eine Fortwirkung von Sicherungsrechten bei Grenzüberschreitung in einen anderen europäischen Mitgliedstaat.
