Die Autorin untersucht, auf welcher Rechtsgrundlage fremde Verletzungshandlungen zugerechnet werden können und prüft die Belastbarkeit der von der Rechtsprechung gezogenen Analogie zu 1004 BGB ("Störerhaftung"). Im Ergebnis wird die mittelbare Verantwortlichkeit als Verkehrspflichtenhaftung eingeordnet, die sowohl mit den Grundsätzen des bürgerlich-rechtlichen kompensatorischen als auch des negatorischen Rechtsschutzes in Einklang steht.
