Abgesehen von steuerlichen Aspekten wurden diese Problemkreise trotz ihrer hohen Relevanz für die Praxis in der betriebswirtschaftlichen Forschung bisher nicht beachtet. Die vorliegende Untersuchung analysiert die Gesellschafterfremdfinanzierung und das Eigenkapitalersatzrecht im Hinblick auf ihre ökonomische Bedeutung für Gesellschafter, Gläubiger und Unternehmensleitung. Zusätzlich erfolgt eine ökonomisch fundierte Beurteilung der Effizienz des Eigenkapitalersatzrechts. Darauf aufbauend werden ökonomisch zweckmäßige Lösungen für wichtige Streitfragen aus diesem Rechtsgebiet vorgeschlagen.
